Terms and Conditions

1. Scope
These Terms and Conditions apply to all orders placed through the Olivoree online store. Our store is intended exclusively for consumers.

2. Contract language and storage of the contract text
The contract may be concluded in English. We store the contract text and send you the order details by e-mail. You can also view your past orders in your customer account, if you have created one.

3. Delivery
We ship products to the delivery address provided during checkout. We only deliver by shipping; collection in person is not possible. Delivery costs and times are described on our Shipping & Delivery page and are shown at checkout before you place your order.

4. Payment
The following payment methods are available in our store:

Credit and debit cards
We accept Visa, Mastercard and American Express. Your card is charged immediately after you place your order.

Shop Pay
With Shop Pay, you can complete your order quickly and securely. Payment is processed by Shopify.

Apple Pay / Google Pay
If you have Apple Pay or Google Pay enabled, you can use them to pay for your order.

5. Retention of title
The goods remain our property until full payment has been received.

6. Damage in transit
If goods are delivered with visible transport damage, please report it to the carrier as soon as possible and contact us without delay. Failing to do so has no effect on your statutory rights, including your rights under the legal guarantee. It simply helps us to make our own claims against the carrier or transport insurer.

7. Legal guarantee
The statutory legal guarantee for consumer goods applies. Under Portuguese law (Decree-Law No. 84/2021), you are entitled to a legal guarantee of conformity of three (3) years from delivery of the goods.

If a product is not in conformity with the contract, please contact us at [store email]. You may be entitled to repair, replacement, a price reduction or termination of the contract, under the terms of the law.

8. Liability
We are liable in accordance with the applicable legal provisions. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our fault, for intentional or grossly negligent conduct, or for any liability that cannot be limited or excluded under mandatory consumer protection law.

9. Right of withdrawal
Consumers have a fourteen (14) day right of withdrawal. Full details and the model withdrawal form are available on our Right of Withdrawal page.

10. Dispute resolution
In the event of a dispute, consumers may contact an alternative consumer dispute resolution entity. 

11. Applicable law
These Terms are governed by Portuguese law. If you are a consumer living in another EU country, you will also benefit from any mandatory provisions of the law of your country of residence.
